【Q1】What is the process of taking in new inmates?

There are four processes when the correctional institutions take in new inmates:

  1. Exam required prison (institution, school) files, such as an escort warrant, a command instructor for execution and a referral letter from courts or prosecutors and verify new inmates’identifications.
  2. Exam new inmates’ bodies, clothes and personal belongings elaborately. Except for the permissible personal belongings, others such as money and restricting or expensive items can be sent to custody, or contact families to take back the items. Female inmates will be examined by female controllers.
  3. Execute health check up in order to understand new inmates’ health conditions (any disease or injury).
  4. Inform the rules which are needed to be followed in the institutions and new inmates will be assigned to their wards after recording all the files.

 

【Q2】When can new inmates purchase daily supplies?

  1. Inmates are allowed to buy their daily supplies on the day they are taken in the institutions.
  2. The institutions provide personal toiletries, daily necessities and clothes for inmates and their relatives to purchase. Inmates’ families can go to the shop inside the visiting and reception room to buy products and the institutions will deliver them to the inmates. Inmates’ families can also go to the reception desk to send money to the inmates and they are able to buy products on their own.

 

【Q3】What sort of food and items are offered from the institutions? How to prepare if those are not enough?

  1. The institutions provide three meals, water, public tableware, uniforms (include a jacket) and etc.
  2. If inmates do not carry any daily supplies, they can buy those by themselves through the institutions. If inmates do not have money with them, the institutions will provide free daily supplies. Furthermore, destitute inmates can apply to the institutions for relief and the institutions will subsidize basic daily necessities.
  3. If inmates have certain special daily needs (artificial limbs, crutches or dentures), they can apply to the institutions for permission and the institutions will do the purchase and deliver to inmates or Inmates’ families can send those supplies through the visiting and reception desk, or apply for permission to send items by post.

 

【Q4】what are the rules of the items which are allowed to carry inside the institutions when new inmates arrive?

  1. The space of the wards inside the institutions are limited so the personal belongings for the new arrivals should be daily necessities and please do not carry too many things.
  2. Money part: Inmates only need to pay for their daily supplies and medical expenses (co-payment and registration fees), except for electric appliances. It is not necessary to bring a big amount of money because there is no high expense in the institutions.
  3. Medical part: Carrying medicines ought to be medical reasons and drug bags, full medical certificates and prescriptions are required. In addition, medicines must be in the sealed packages with ingredient illustrations and those will be returned back to inmates after doctors’ examinations. *Prescriptions within 2 weeks (start from the day when inmates are taken inside the institutions) or continuous prescriptions of chronic diseases within 3 month.
  4. Daily supplies: Personal identifications, underwear, socks, towels, pens, soaps, toothpastes, toothbrushes, envelopes, letter paper, tissue, books and magazines (without any violent and pornographic photos)and single bed linen are allowed to be brought inside the institutions. There are special items, such as artificial limbs, artificial eyes and dentures can be used inside the institutions after verifying.
  5. Protocols for clothes examination:
    1. The purposes of examining clothes are based on the needs from inmates and clothes integration. In order not to affect the security in the institutions, forbidden items which include not easy or cannot be checked or original functions and appearances will be different after the examination are all not allowed to bring inside the institutions.
    2. Electronic devices are not allowed to bring inside the institutions, however there are two conditions electronic devices can be brought into the institutions after verifying and changing the tags. First, if inmates are transferred from other prison (institution, school). Second, inmates return from the outsourced detention.
    3. Clothes, bed linen, socks, towels and etc must be unsealed and be soaked in water to help examining process go smoothly.
    4. If the items are involved in any illegal matters, the institutions will deal with them according to the laws.

 

【Q5】Is the executing institutions according to the household registration address or crime location?

  1. Generally speaking, the executing institutions will be city where inmates conduct crimes, but they can apply to original courts where give the verdicts or the prosecuting institutions for transferring to the institution where is near to convicts’ household registration address.
  2. After executing, it is feasible if inmates would like to apply for transferring to the institution where is near to the household registration address. According to the relevant legislations, inmates or people receiving rehabilitation treatment can apply for permission; however related documents, such as institution transferring applications and household registration transcripts are required.

 

【Q6】What sort of situations the institutions will decline to take in the inmates?

  1. Inmates cannot be taken in the institutions if they conform with following situations:
    1. Mental incapacity or those who may have high risks of losing lives during the execution of sentences.
    2. Have been over 20 weeks pregnant or only delivered babies within 2 months.
    3. Affected by acute epidemics.
    4. Senescence, disabilities (cannot take care of their daily lives).
  2. Inmates should provide related certificate or files, such as diagnosis certificate, clinical history, pathology reports or other examination reports.
  3. Inmates who are refused custody by the institutions will be sent to the appropriate place, such as hospitals after prosecutors’ evaluations.

 

【Q7】What if inmates are suspected of suffering from pulmonary tuberculosis before arriving in the institutions?

  1. If inmates are suspected of suffering from pulmonary tuberculosis, they can apply to prosecutors for delay execution with related certificates. However the institutions will still take in inmates if prosecutors decline the applications.
  2. After being imprisoned, inmates should show related certificates and pulmonary tuberculosis treatment manual and the institutions will arrange doctors and further treatments, or follow professional medical instructions to conduct the isolation and treatment.
  3. If the case is positively confirmed with pulmonary tuberculosis, the institutions will report to Agency of Corrections, Ministry of Justice. After the permission, Male inmates will be transferred to Taichung Prison Pei-De Hospital or female inmates will be transferred to Taipei Prison Toayuan branch to get medical treatments.

 

【Q8】What sort of medical care would inmates get after they are imprisoned?

  1. Prevention and Health care: Carry on regular health checkup. Record and track on inmates who have chronic diseases or special diseases. Execute health education to prevent diseases happen.
  2. Disease treatment: Inmates’ sickness will be checked up and treated by doctors.
  3. Infectious diseases prevention: The institutions will execute infectious disease blood test (Acquired Immune Deficiency Syndrome (AIDS) or syphilis) and chest X-ray, in order to find the diseases and cure them in time. Furthermore, the institutions also regularly hold expanding health screenings a year based.

 

【Q9】Do inmates obtain national health insurance? Do inmates need to pay for the health insurance?

  1. Investment diagnosis for Inmates from correctional institutions
    1. 4th Category item 3 (Ministry of Justice will subsidize the insurance fees): Those who are serving sentences in correctional institutions or receiving punishments from, police, such as inmates serving sentence, people receiving rehabilitation treatment, people subjected to compulsory labor, people subjected to compulsory treatment (Criminal Code of the Republic of China 91-1) or students subjected to educational discipline. However, this is not applicable to those who are serving sentences of less than two months or are under parole.
    2. Not in 4th Category item 3 (No subsidies): Those who are serving sentences less than two months, defendants, people under observation or juvenile inmates.
    3. Not being qualified to have national health insurance: Inmates are not tallies with Article 8 and Article 9 (National Health Insurance Act) ; however if inmates obtain resident permits and stay over 6 months (based on the National Immigration Agency’s database), they can be part of the national health insurance members.
  2. Inmates’ insurance fees are 1376 NT dollars a month. Inmates belong to Category 4 Item 3 do not have to pay for the fees.

 

【Q10】Do inmates have to pay for the fees when go to doctors, if they have already possessed national health insurance? What are the expenses?

  1. Inmates medical payments are as follows:
    1. Registration fees: Registration fees of Outpatient clinic inside the institutions are around 0-100 NT dollars. The charges for registration fees are different from hospitals to hospitals.
    2. Co-payment: Co-payment fee of outpatient clinics inside the institutions is 50 NT dollars (Related Legislation. Please refer top Article 7 Item 1). According to National Health Insurance Act Article 48, in case of the following circumstances, the beneficiaries shall be exempted from co-payment.
    3. Hospitalization expenses: The self-bearing ratio of hospitalization expenses are around 10% - 30%. The ratio will be higher if length of hospital stay is longer.
  2. If inmates cannot pay for the self-bearing co-payment and registration fee, correctional institutions will continuously deduct inmates’ custody money and labor income or inform inmates’ families to pay for the bills. If the inmates haven’t paid up the bills but have been released from the prison (institution, school), the cooperative hospitals (clinics) will do the further reminding.
